PRIVACY POLICY OF GOURMET’S INTERNATIONAL – DATA CONTROLLER –

Gourmet’s International Srl organizes and manages advanced training seminars, update meetings, gastronomy courses, both independently and in collaboration with partners, institutions, and universities. It organizes events dedicated to the food and wine sector in Italy and abroad, as well as training courses sponsored by the European Social Fund (ESF).
 
In compliance with EU Reg. 2016/679 (European Regulation on the protection of personal data), we process your data respecting the principles of lawfulness, transparency, limitation, and minimization as provided by Art. 5 GDPR. We provide you with the necessary information regarding the processing of the personal data provided. This information is not valid for other websites that may be accessible through links on the domains of the owner, who is not responsible in any way for third-party websites.
This information is provided pursuant to Art. 13 and 14 of EU Reg. 2016/679 (European Regulation on the protection of personal data).

Personal Data Processed:
“Personal data”: any information concerning an identified or identifiable natural person (“data subject”).

Browsing Data

The computer systems and software procedures used to operate this site acquire, during their normal operation, some personal data whose transmission is implicit in the use of Internet communication protocols. This category of data includes IP addresses or domain names of the computers and terminals used by users, the addresses in URI/URL (Uniform Resource Identifier/Locator) notation of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters relating to the user’s operating system and IT environment.

Data Provided by the Data Subject

The optional, explicit, and voluntary sending of messages to contact addresses, as well as the completion and submission of forms on the Owner’s site, involves the acquisition of the sender’s contact data, necessary to respond, as well as all personal data included in the communications.

Specific information will be present, if necessary, on the pages of the Site in relation to particular services or processing of the provided Data.

Data Required for Event Registration

The data requested will be strictly necessary to ensure registration for the event.
The processing of your Data is aimed at:

  1. registration and participation in the event;
  2. sending service communications such as registration confirmation, QR code, etc.
  3. use of photographs and videos;
  4. sending information about the event.

Possible Registration/Accreditation and Ticket Purchase for Event Participation

To proceed with the reservation, you will be asked for the email address, hash of the chosen password, times, and IP addresses of the connections. No personal data relating to the credit cards chosen for payment are processed. This information is necessary to authorize the issuance of the ticket following payment, to respond to any requests, or to produce evidence in case of requests by entities (e.g., banks) or in case of investigations by authorities.
If the purchase is successful, you will receive the ticket also via email.
In case of registration request as an operator in the sector, partner, or press member, the common data collected will be used to send you the accreditation code necessary to collect the pass.
The data collected in this form will be processed by a company duly contracted by us as Data Processor, acting as the manager of the reserved area.

Social Network Plugins

The Gourmet’s International Srl website may also incorporate plugins and/or buttons for quick sharing on your favorite social networks (Facebook, YouTube, Telegram, LinkedIn, etc.). By clicking on the plugin and/or button that may be present on our website, your browser connects directly to your social network server. The collection and use of information by such third parties (social networks) are governed by their respective privacy policies to which we invite you to refer.

PURPOSE AND USE OF VIDEOS/PHOTOGRAPHS

The organized event is of a public nature; therefore, any personal data that may be collected through photographic images or audio-video recordings will be primarily aimed at and instrumental to documenting the event. For this purpose, they will be disseminated through the most commonly used communication means today, such as the Owner’s website and social networks (Facebook, YouTube, etc.).

The images collected will therefore be primarily focused on the environmental context in which the public event takes place, taking care not to capture the faces of those present in the foreground or frontally but with angles that limit the recognizability of the subjects and/or taken from a long distance.

It should be noted that pursuant to Art. 97 of Law 633/1941 “Consent of the portrayed person is not required when the reproduction of the image is justified by the notoriety or public office covered (…), for scientific, educational, or cultural purposes, or when the reproduction is connected to facts, events, ceremonies of public interest or held in public.” Therefore, consent will not be required from the data subject captured in photographic or video images taken in places and spaces where public university events are held (conferences, press conferences, workshops, public outreach meetings, and orientation initiatives, etc., also held at non-university locations such as municipal halls, public spaces, etc.). It is indeed reasonable to believe that participants in a sporting, social, or nationally relevant scientific congress are well aware, if not even satisfied, of the probability of being portrayed and that such data processing takes place for the purpose of dissemination and promotion of the event itself as part of the organizer’s activities.

It has also been verified that there is a relevant and appropriate relationship between the data subject and the data controller, constituted by the purchase of the entrance ticket or registration for the event and the consequent appointment of the data subject as a participant (see Recital 47 GDPR).

Given this condition, it is possible to invoke, as the legal basis of the processing, the legitimate interest of the operator which does not require the consent of the data subject.

Purpose A)

Browsing the Website

LEGAL BASIS: legitimate interest art. 6 lett. f) and Recital 47: the processing is necessary for the pursuit of the legitimate interest of the data controller or third parties, provided that the interests or fundamental rights and freedoms of the data subject which require the protection of personal data do not prevail, considering the reasonable expectations held by the data subject based on his or her relationship with the data controller. Activities strictly necessary for the operation of the site and the provision of the browsing service on the platform.

DATA RETENTION PERIOD: until the end of the browsing session. For navigation, see the cookie policy.

NATURE OF THE PROVISION: except as specified for navigation data (which are necessary to allow navigation of the website), the user is free to provide personal data.



Possible Data Collection Form for Contact or Event Registration:
LEGAL BASIS: based on the execution of pre-contractual measures adopted also at the request of the data subject.

DATA RETENTION PERIOD: 1 year for contacts, accreditation requests, or ticket purchases for events. For training courses, the provided data will be retained for the duration of the course and for the subsequent 10 years for administrative purposes.

NATURE OF THE PROVISION: the provision of data is optional or necessary depending on the specific purpose for which the data is processed. Failure to provide data marked with the symbol * or the term (required) will make it impossible to obtain what is requested or to use the services of the data controller.



E-commerce and Administrative and Accounting Activities Consequently, Including Possible Registration on the Site or Platform:
LEGAL BASIS: art. 6 lett. b) GDPR: the processing is necessary for the performance of a contract to which the data subject is a party (e-commerce) or based on the execution of pre-contractual measures adopted also at the request of the data subject.

DATA RETENTION PERIOD: Until opposition, deletion from the web platform, 10 years, or different legal obligation. Art. 2220 C.C.

Softspam:
Commercial/promotional information activities, newsletters by email to the email address provided during the sale, regarding the same type of product and/or service (Soft Spam) similar to the product/service subject to the sale – art. 130, paragraph 4 D.lgs. 196/03 / (art. 6 lett. f) EU Reg. 2016/679), unless opposed. The Owner, to compare and possibly improve the results of the communications, uses systems for sending newsletters and promotional communications with reports. Thanks to the reports, the Owner can know, for example: the number of readers, openings, unique clicks, and clicks; the devices and operating systems used to read the communication; details on the activity of individual users; details of sent, delivered, and not delivered emails, those forwarded. All this data is used to compare and possibly improve the results of communications.

LEGAL BASIS: Legitimate interest- art. 6 lett. f) and Recital 47: the processing is necessary for the pursuit of the legitimate interest of the Data Controller to maintain contact with its customers to continue the established collaboration relationship, provided that the interests or fundamental rights and freedoms of the data subject do not prevail and art.130, paragraph 4 D.lgs.196/03

DATA RETENTION PERIOD: Until your opposition (opt-out) through the “unsubscribe” button or request sent to the addresses of the Data Controllers indicated.



Use of Videos and Films:
LEGAL BASIS: Legitimate interest art. 6 lett. f) and Recital 47

DATA RETENTION PERIOD: The photographic images and audio and video recordings will be kept in the Owner’s archives, in relation to their possible use for the indicated purposes, for a period of five years. Data not controllable by the Owner disseminated on the web (Facebook, YouTube, Instagram, Twitter, etc.) are excluded.



Purpose B)
Direct Marketing:

If the data subject completes dedicated forms for data collection, in specific areas for Direct Marketing purposes: prior consent and until its opposition for direct marketing activities by the Owner, market research, direct sales, satisfaction surveys, sending newsletters, and promotional, commercial, and advertising material or related to events and initiatives, by the Owner through automated means of email, fax, SMS or other types of messages, as well as through operator phone calls, including automated ones, and traditional mail and other information material.

The Owner, to compare and possibly improve the results of the communications, uses systems for sending newsletters and promotional communications with reports. LEGAL BASIS: Consent art. 6 par. 1 lett. a): the data subject has consented to the processing of their personal data.

DATA RETENTION PERIOD: Until your opposition (opt-out/revocation of consent)

NATURE OF THE PROVISION: The provision of data for Purpose B) is optional and in the absence of it, your data will not be processed for this purpose; the refusal of provision will not affect the usability of the purposes referred to in point A).

 

Data Communication Purpose A and B

The personal data provided will be shared with subjects who will process the data as processors (art. 28 of EU Reg. 2016/679) and/or as natural persons acting under the authority of the Owner and the Processor (art. 29 of EU Reg. 2016/679), for the purposes listed above (e.g., subjects providing services for the management of the information system including email, newsletters, etc. (e.g., Sendinblue), consultants, third parties collaborating with the Data Controller for direct marketing activities or training activities, entities, authorities, etc.). The list of processors is always updated and available by contacting the Data Controller at the address above.

Data Transfer Outside the EU Purpose A and B

The personal data provided will not be transferred to non-EU countries.

Automated Process Purpose A and B

We do not use decision-making processes based on automated processing, including profiling. Exclusively for videos and photographs, Data processing will be mainly carried out with the help of electronic or automated tools. The data will also be managed and protected in environments where access is under constant control.

You have the right, at any time, to request access to your personal data, rectification, deletion, limitation of processing, and portability of your data from the Data Controller. Additionally, you have the right to object, at any time, to the processing of your data based on consent and/or legitimate interest. To no longer receive automated direct marketing communications (e.g., email, SMS), simply write an email at any time to info@meranowinefestival.com with the subject “unsubscribe from automated” or use our automatic cancellation systems provided for emails only.
